    • Distributing illegal substances or human trafficking (you probably shouldn't be using a fulfillment center for these anyway)

  • Service Description: Mix-Mix Mail provides third-party logistics and warehousing services, as well as design, printing, and photography services as described on our website. We reserve the right to modify or discontinue any service at any time.
  • Fees: You agree to pay all applicable fees for the services you use. Fees are detailed on our website and are subject to change. All fees are non-refundable except as expressly provided in our Return and Refund Policy.

3. User Content

  • Responsibility: You are responsible for any content you submit, post, or transmit through our Services. You grant Mix-Mix Mail a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute your content in connection with our Services.
  • Prohibited Content: You agree not to submit, post, or transmit content that:
    • Is defamatory, obscene, or offensive.
    • Infringes on the intellectual property rights of others.
    • Contains viruses or other harmful components.

  • Limitation of Liability: To the fullest extent permitted by law, Mix-Mix Mail shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
    • Your use of or inability to use our Services.
    • Any unauthorized access to or use of our servers and/or any personal information stored therein.
    • Any interruption or cessation of transmission to or from our Services.

8. Governing Law These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

9. Dispute Resolution Any disputes arising out of or relating to these Terms or the use of our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Los Angeles, California.

10. Changes to Terms We reserve the right to modify these Terms at any time. Any changes will be posted on our website with the updated "Last updated" date. Your continued use of our Services after any changes constitutes your acceptance of the new Terms.

11. Service Availability

  • Service Launch Dates: Some of our upcoming services, including the Tokyo warehouse and Direct Connect, are labeled as "coming soon." We reserve the right to modify launch dates and availability. We are not liable for any delays in upcoming service availability.

12. International Shipping and Customs

  • Responsibilities: Mix-Mix Mail provides assistance with customs documentation and FDA Prior Notifications as part of our Services. However, we are not responsible for any delays or issues that may arise during customs clearance. Customers are responsible for ensuring compliance with all applicable import/export laws and regulations.

13. Integration with eCommerce Platforms

  • Direct Connect: Our Direct Connect service allows for integration with various eCommerce platforms. Users are responsible for the security and privacy of any data exchanged through these integrations. Mix-Mix Mail is not liable for any data breaches or issues that may arise from third-party platform connections.

14. Multilingual Support

  • Support Limitations: We offer Services in multiple languages; however, there may be limitations regarding availability and response times for multilingual support. While we strive to provide accurate translations, we do not guarantee error-free service.

15. Custom Packaging and Inserts

  • Design Approval: Custom packaging and inserts are subject to a design approval process. Additional costs may apply, and potential delays may occur. Customers are responsible for timely approval of designs to avoid disruptions. 

16. Liability for Errors in Fulfillment

  • Corrective Measures: In the event of errors in fulfillment, such as incorrect or damaged shipments due to errors or negligence by Mix-Mix Mail, we will take reasonable steps to rectify the issue. Compensation or corrective measures will be determined on a case-by-case basis.

17. Intellectual Property for Packaging Design

  • Ownership Rights: If Mix-Mix Mail provides packaging design services, the intellectual property rights for such designs remain with Mix-Mix Mail until full payment is received. Upon receipt of payment, rights may be transferred to the customer as agreed upon in writing.
